was held at the EBA office in Lviv. Present member – companies` representatives considered the draft of the Law of Ukraine on operations on processing of import raw material on the territory of Ukraine, which had been proposed by the company “LEONI”. The examination of the above mentioned draft Law included discussion of imperfection aspects of tolling scheme for the majority of production companies, and search of the possible way of its legislative regulation. The participants of the meeting paid their particular attention to the following problematic issues, namely:

-          Guaranteeing (avalizing) promissory notes;

-          Impossibility of urgent changes  foresight to the tolling agreement;

-          Raw materials remnants left after 90 days (purchase and sale);

-          Remnants utilization (permissions, export, import, taxation);

-          Processing regime at the customs territory (new permission to the tolling agreement).

 

Besides, the participants discussed VAT refund for the newly established companies and statutory fund fixed assets (capital) VAT – Subparagraph 3.2.8., Paragraph 2.8, Article.3 of the Law of Ukraine on Value added tax.

 

It was also agreed to circulate the aforementioned draft Law among the EBA Western Ukrainian branch members for their comments till September 21, 2006 to the EBA office in Lviv.
