On 4 September 2009 the Ministry of Justice published the Draft on Public Influence on Adoption of Legislative Acts (Draft on Lobbying) for discussion. The Draft provides for definition of terms such as lobbying, lobbying activity, lobbying contacts, aim and methods of lobbying, etc. It is stated in the Draft Law, that it is effective for subjects of lobbying activity aimed at legitimate influencing state authorities in course of adopting legislative acts.

2009		 The President issued the Decree Voiding Government Instructions regulating Tax related Issues
On 4 September 2009 the President issued the Decree on Voiding point 2 of the CMU Instruction No. 757-p dated 1 July 2009 and the CMU Instruction No. 838-p dated 17 July 2009. The EBA strongly opposed legitimacy of respective legislative acts and had already addressed respective appeals on this matter to different authorities. On 26 August 2009 the Draft Law on State Land (Mortgage) Bank of Ukraine was registered in the Parliament with No. 4337-1. It is stated in the Draft, that the state land (mortgage) bank functions as the specialised bank on the territory of Ukraine aiming at developing credit granting system for agricultural sector of economy, in particular, on security of land plots, right to them and other real estate property.

2009		 Measures on Rehabilitation of Ukraine’s Gas Transit System Approved
On 5 August 2009 the Cabinet of Ministers of Ukraine approved the Action Plan Implementing Joint Statement on Results of the International Investment Conference on the Rehabilitation of Ukraine’s Gas Transit System for the Second Semester of 2009. Respective Instruction No. 927-p was posted at the official web-site of the Government. The Action Plan covers 5 points of instructions to be implemented by the state authorities of Ukraine till the end of 2009.

2009		 The State Customs Service Updated Tax Clarification on Foreign Investments
Following the EBA lobbying efforts and numerous appeals to state authorities including the Ministry of Finance and the Ministry of Justice, the State Customs Service (SCSU) issued the Order No. 701 dated 28 July 2009 updating its tax clarification (in line with our request) approved by the SCSU Order No. 31 dated 20 January 2009 that no import duties should be paid upon alienation of corporate rights from one foreign investors to another.

2009		 Import Quotas for Tubing Removed
At the EBA Initiative Interdepartmental Commission on International Trade Removed Import Quotas for Seamless Steel Casing and Tubing. On 21 July 2009 the EBA took part in the meeting of the Interdepartmental Commission on International Trade were the issue raised by the EBA member companies on quotation of tubing products required for exploration and production of indigenous hydrocarbons in Ukraine was considered and respective decision to remove quotas till April 2010 was taken (the decision was officially published in Uriadovyi Courier No. 136 dated 30 July 2009).

2009		 Legitimacy of 13% Import Surcharge
As the EBA informed earlier, the State Customs Service of Ukraine addressed to the Cabinet of Ministers of Ukraine the official letter asking to provide instructions on further application of Resolution No. 230 dated 18 March 2009 (with this Resolution the Government shortlisted the goods subject to 13% import surcharge). Following the Constitutional Court Decision No. 15-ðï/2009 dated 23 June 2009 legitimacy of the Cabinet of Ministers Resolution No. 230 became disputable.

The EBA lobbying efforts as for ensuring free access to all mandatory legal documents at the official web-sites of the state authorities are progressing. Thus in accordance to the Cabinet of Ministers of Ukraine Resolution on Certain Aspects of Providing Paid Services No.724 dated 1 July 2009 the State Committee for Technical Regulation and Consumer Policy (Derzhspozhyvstandart) is obliged to publicise all the technical regulations and state standards on its web-site by 1 October 2009 and update the relevant information on the permanent basis.

On 24 June 2009 the Cabinet of Ministers of Ukraine adopted the Resolution on Establishing State Migration Service No.643. 2009		 Law on Mitigating Impact of Crisis was Proclaimed Unconstitutional
On 14 July 2009 the Constitutional Court of Ukraine made a decision on proclaiming unconstitutional the Law on Amending Certain Legislative Acts of Ukraine (on mitigating impact of global financial crisis on domestic industry development) No. 694-VI dated 18 December 2008. As stated in respective Decision of Constitutional Court of Ukraine No. 18-ðï/2009, the procedure of coming in force of this Law was violated and therefore according to the Constitution such Law was proclaimed unconstitutional.

On 16 July 2009 the Draft Law on Self-Governing Organisations was registered in the Parliament with No. 4841. The Draft Law is aimed at realisation of state policy on protection of interests of business entities and lowering the state control over their professional relations as well as on creating effective system of cooperation between business and the state. According to the Law the self-governing organisations are non-commercial organisations based on membership and uniting business entities functioning in certain sphere of professional activity.

2009		 EBA Proposals Regarding Labelling Food Products, Containing GMO Were Considered
On 1 July 2009 the Cabinet of Ministers of Ukraine adopted Resolution No.661 amending the Order of Labelling Food Products, Containing GMO No.468 dated 13 May 2009. The alterations suggested by the EBA were taken into consideration in the part of estimation 0,9% margin value of the possible GMO content in food products not subject to labelling.

On 18 June 2009 the Presidium of the Highest Commercial Court of Ukraine issued Recommendations No. 04-06/83 on amending and developing the Recommendations of the Presidium of Highest Commercial of Ukraine No. 04-5/14 dated 18 December 2007 on Common Practice of Legislation Application in Consideration of Cases related to Corporate Relations. The recommendations aimed at approximating common court practice in application of the material and procedural norms in deciding corporate disputes.

2009		 EBA Met Head of the State Tax Administration of Ukraine Mr. Serhiy Buriak to Lobby for VAT Refund and Legislative Amendments Expected by Business Community.
On 1 July 2009 the EBA had an off-the-record meeting with Head of the State Tax Administration of Ukraine Mr. Serhiy Buriak, and his Deputies Mr. Serhiy Chekashkin and Mr. Serhiy Lekar. Also other STAU experts were present at the meeting. At this meeting we discussed strategy of collaboration with the STAU and certain concrete issues, like: taxation of currency exchange differences; taxation of certain banking transactions; taxation of life insurance activity, definition of “royalty”, tax “gaps” in terms of invalidation of agreements and of course the VAT refund problems faced by the EBA members.

2009		 Constitutional Court's Decision on 13% Purpose Surcharge to the Import Duties
The Constitutional Court of Ukraine has ruled as unconstitutional the right of the Cabinet of Ministers to limit, cancel and prolong application of 13% temporary purpose surcharge to the import duties as it is stated in the respective Decision of the Constitutions Court of Ukraine No. 15-ðï/2009 dated 23 June 2009. After adoption of the Law on Amending Certain Legislative Acts of Ukraine for Improving Balance of Payment in Terms of Global Financial Crisis No. 923-VI dated 4 February 2009 the President of Ukraine applied to the Constitutional Court to confirm legitimacy and constitutionality of amendments introduced by the Law No. 923-VI to the Laws on Customs Tariff and on Foreign Economic Activity empowering the Government to decrease or even cancel temporary purpose surcharge to the import duties or to prolong it’s application for 6 months more.

On 25 June 2009 the Parliament adopted the Law on Basics of Public Private Partnership (respective Draft Law registered with No. 3447-ä dated 14 April 2009). 2009		 Parliament Adopted Amendments to Legislative Acts for Preventing Negative Consequences of Financial Crisis
On 23 June 2009 the Verkhovna Rada of Ukraine adopted the Law on Amending Certain Legislative Acts of Ukraine for Preventing  Negative Consequences of Financial Crisis (respective Draft was registered in the Parliament on 10 February 2009 with No. 3585).  In particular, this Law envisages that banks and other financial institutions except for insurance companies, private pension funds, corporate investment funds and administrators of private pension funds, will create reserves for compensating damages for all types of credit operations.

2009		 Parliament Adopted Laws related to Fighting Corruption
On 11 June 2009 the Parliament adopted the Law on Responsibility of Legal Entities for Corruption Violations (Draft Law No. 0877 dated 23 November 2007). This Law envisages responsibility of legal entities for corruption violations of their authorised persons and provides for procedure of bringing them to justice. Discussion of this Draft Law was initiated by one of the EBA members companies and its adoption is a step forward towards realisation of the EBA lobbying initiatives.

The National Electricity Regulatory Commission of Ukraine (hereinafter - NERC) published the Draft Resolution of the National Electricity Regulatory Commission of Ukraine on Amending the Procedure of Establishment, Revision and Termination of «Green» Tariff for the Entities of Economic Activity. The Draft specifies a mechanism for the establishment of a fixed minimum level of «green» tariff/tariffs for different types of alternative energy sources.

2009		 EBA Efforts Establishing “0” VAT Rate for International Forwarding Services was Supported by the Parliament
On 12 June 2009 the Parliament adopted the final wording of the Law on Amending Certain Laws of Ukraine Regarding Taxation of International Forwarding Services (respective Draft Law No. 3552 was registered on 25 December 2008). This Law envisages “0” VAT rate for cargo forwarding services by auto transport companies both inside and outside of customs territory of Ukraine. Head of the Parliament Committee on Tax and Customs Policy MP Serhiy Terekhin agreed to collaborate with the EBA on a number of concerns and particularly on settling an issue related to tax implication of currency exchange rate differences for tax payers, including life insurers. On 3 June the EBA Executive Director and Chairs of the EBA Tax, Legal and Life Insurance Committees were invited by Mr. Terekhin for discussing burning issues in terms of taxation and insurance and considering concrete solutions mutually acceptable by both business and the state.

2009		 International Monetary Fund released the First Review Under the Stand-By Arrangement
On 2 June 2009 the International Monetary Fund released the First Review Under the Stand-By Arrangement. According to the Review the Cabinet of Ministers, the Parliament and the National Bank of Ukraine must retain fiscal discipline of the State Budget, actively seek internal and external sources of loans, not restrict operations with capital, save positive interest rates (interest on deposits must be the higher than expected inflation of 16%), and restrict the devaluation pressure on a currency market. 2009		 Draft Law regarding Organisational and Holding Final Part of EURO 2012 in Ukraine Adopted as a Basis
On 21 May 2009 the Parliament adopted as a basis the Draft Law on Amending the Law on Organisation and Holding Final Part of Football Championship EURO 2012 in Ukraine No. 4397 dated 21 April 2009. The Draft Law envisages also changes to the Land Code, the Law on Single Customs Duty and the Law on Planning and Building-up Territories.
The Draft Law provides for the range of definitions of terms, such as construction of championship objects, general infrastructure plan, agreement on use of championship object, guarantees, championship event, UEFA intellectual property, prohibited marketing etc.

2009		 Government Initiates Legislative Amendments in Line with Accession to the Convention on Temporary Import

2009		 Inflation Report of the Ministry of Economy of Ukraine
According to the official report of the Ministry of Economy of Ukraine there is a positive inflation rate dynamic in Ukraine. 2009		 Parliament adopted the Law for stimulating alternative energy use
The Parliament of Ukraine adopted the Law on Amendments to Certain Laws of Ukraine concerning promoting alternative energy sources use (respective Draft Law was registered in the Parliament on 26 March 2009 with No. 4267) and passed it to the President on 6 April 2009.  The goals of the amendments were to stimulate production and implementation of energy saving technologies and fostering the use of alternative sources of energy. Doing so increases the competitiveness of domestic goods producers in their reduction of energy usage, and the improvement of a state trade balance by the consumption of less foreign sources of energy.

On 25 March 2009 the meeting of the Cabinet of Ministers of Ukraine was held, during which the Minister of Health of Ukraine Mr Knyazevych reported on the medical drugs pricing regulation development. Consequently Amendments to the CMU Resolution No 955 of 17 October 2008 on Some Measures to Stabilize Prices on Medical Drugs and Medical Devices regarding the price regulation, which were discussed during the meeting, held on 23 March 2009 at the Ministry of Health, were approved by the Cabinet of Ministers of Ukraine. This document introduced the mark-ups rate for distributors and retail segment of the pharmaceutical sector.

On 24 March Head of the State Customs Service of Ukraine Anatoliy Makarenko issued the letter No. 11/1-10.21/2619-ÅÏ ÄÑÊ (for official use only). With this letter Mr Makarenko instructed customs officials not to apply 13% extra import duty previously imposed by the famous Law on Amending Certain Legislative Acts of Ukraine for Improving Balance of Payment in Terms of Global Financial Crisis No. 923-V but saving this restriction only for goods classified with 8418 and 8703 UKTZED codes (cars and refrigerators).

2008		 Ukraine on its way to PIC/S (continuation)
On 11-12 November the next round of negotiations between Ukrainian authorities and PIC/S Secretariat took place in Geneva within the framework of the PIC/S Committee meeting. On the second day of the sitting Ukrainian Reporter - representative of the Ireland Inspectorate, presented the second review of the Assessment Report on Ukraine. This report comprised the problematic issues to be solved and also reflected a progress dynamics. In general the review was positive and encouraging. Furthermore the attendees considered fulfilment of the joint action plan on membership achievement agreed upon in Krakow (Poland) at the previous PIC/S meeting. During the discussion the participants paid special attention to implementation of the obligatory GMP requirements to take effect in Ukraine since 1 January 2008.

2008		 Draft Customs Regulations
Recently the State Customs Service of Ukraine (hereinafter - SCSU) elaborated and proposed for public discussion several draft customs regulations, in particular: 
1. Draft Order on Approving Regulation of Delivery Points for Goods and Transport Vehicles. The Draft abolishes currently applicable SCSU Order on Delivery Point of Motor Vehicles and provides for a new procedure for defining delivery points of goods transported by motor vehicles as well as sets requirements to such delivery points.

2008		 Novelties in State Regulation of Prices
Recently the Ministry of Economy of Ukraine elaborated a couple of draft Resolutions focusing on state price regulation. One of these regulations is the Draft Resolution on Amendments to the CMU Resolution No. 1548 establishing responsibilities of state authorities in terms of price regulation. The draft amendments exclude provisions on powers of city councils in terms of price regulation from the CMU Resolution No. 1548. In particular the Draft revokes powers of Lviv and Krivyirig city councils to regulate urban transport tariffs.

The Ministry of Economy of Ukraine elaborated the Draft Resolution Approving List of Goods Subject to Export and Import Licensing and Quotation for 2009. Each year the Cabinet of Ministers of Ukraine (hereinafter – CMU) establishes respective list taking into account current conditions. According to the Draft total quotas for goods subject to export licensing remains the same as it was in 2008 covering gold, silver and their waste.

2008		 The Ministry of Justice opened access to Single State Register of Enforcement Proceedings
As informed by the Ministry of Justice as of 7 November 2008 the access to judges’ decisions, which are submitted to the State Enforcement Service, was opened. The information on all court decisions which were submitted for enforcement proceeding to the State Enforcement Service under the Ministry of Justice of Ukraine is included to the Single State Register of Enforcement Proceedings (hereinafter – the Single Register). Now the parties involved in enforcement proceeding are able to obtain a complete extract of information from the Single Register, including data on conducted enforcement activities.

2008		 Draft import permit procedure for telecommunication devices
The National Commission on Communication Regulation of Ukraine (herewith and after NCCRU) elaborated the Draft Resolution on Permits for Import of Radioelectronic Facilities and Radiated Devices. Abovementioned Draft was envisaged taking into account provisions of the Law of Ukraine on Radio Frequency Resource of Ukraine regulating import, use and distribution of telecommunication devices as well as responsibilities of state authorities in this field. Draft Resolution provides for import permit procedure for radioelectronic facilities and radiated devices, their receipt in post offices from foreign countries, including by courier mail as well as provides the list of radioelectronic facilities and radiated devices which don’t require import permit.

The amended version of the Order of the Ministry of Health on Approval of the Procedure of Expertise of Materials Submitted for the State Registration (Re-registration) as well as Expertise of Materials on Amendments to the Registration Materials during the Registration Certificate Validity Period No 426 dated 26 August 2005 will come into force on 1 November 2008. The latest amendments to the regulation were adopted by the Order of the Ministry of Health No. 536 as of 25 September 2008. This progress in improvement of the legislative basis can become another step on the way of instilling European and world standards in Ukraine.

2008		 CMU stabilised the medical drug prices
Continuing the reforming of the pharmaceutical industry the Cabinet of Ministers of Ukraine adopted the program of the medical drugs prices stabilisation. This decision was approved on the unscheduled Cabinet of Ministers meeting which was held on Friday 17 October 2008. According to the Governments decision the mark-ups for the distributors and retail was agreed on the next positions relatively - 10 % and 25%. Thus the price over the 70 % of medical drugs will be under the State control.

2008		 Draft gas regulations
Recently the Ministry of Fuel and Energy of Ukraine submitted to the State Committee on Regulatory Policy and Entrepreneurship the Draft Order on Amendments to the Rules for Accounting Natural Gas during its Transportation by Gas Distribution Networks, Delivery and Consumption. The Draft aims to reduce natural gas loss exceeding the planned rates set for gas supplying and gasifying enterprises through developing  additional tools to influence the owners of metering gas stations. The main idea of the abovementioned Rules is to stipulate common requirements to technical and metrological characteristics of measuring devices applied at commercial metering gas stations. Gas price hikes sharply increased the urgency to implement these Rules.

2008		 Budget Preparations
The State Budget Bill for 2009 was considered by the Parliamentary Committee on Finance and Banking on 1 October 2008.  As proposed in the respective Draft Law No. 3000 registered in the Parliament  on 15 September 2008 the state’s revenue will be 288.1 billion UAH, expenditures are fixed at the level of 302.2 billion UAH and marginal deficit will be 17.4 billion UAH (approximately 1.37 of the GDP).

On 25 September 2008 the EBA was present at the meeting of the Parliamentary Committee on Taxation and Customs Policy. Among other Draft Laws talked over by the Committee members, there was the Draft Law on Amendments to the Customs Code (hereinafter – the Draft Customs Code) No. 2778 as of 16 July 2008 brought up for discussion. The Draft Customs Code is invoked to bring into compliance provisions of the Customs Code of Ukraine and the International Convention on Simplification and Harmonization of Customs Procedures (hereinafter – the Kyoto Convention). Several tax-related Draft Laws were submitted for consideration to Verkhovna Rada. The Extended session of the Working Group on Taxation and Customs Policy under the CMU Investors Council (Working Group) took place in the office of the Ministry of Finance of Ukraine on 2 July 2008.

2008		 Round Table on How to Reduce Corruption in Real Estate and Land Permitting System

The Round Table on How to Reduce Corruption while Obtaining a Permit for Construction and Conducting Land-related Operations was organised at the National Union of Journalists of Ukraine. The Round Table was initiated by the project Promoting Active Citizen Engagement (ACTION) in Combating Corruption in Ukraine, which has been launched by the United States Agency for International Development (USAID). Representatives of the state authorities, business and non-governmental organisations attended the Round Table to discuss the pressing problem of corruption in the construction and land permitting system.

On 11 June 2008 the Draft Resolution of the Cabinet of Ministers of Ukraine on Criteria of Dividing Enterprises Based on Risk in their Activity in Production of Goods, Delivery of Services or Execution of Work was published on the web-site of the State Committee for Technical Regulations and Consumer Policy. Based on the risk assessment the enterprises are categorised into high-, medium- and low-risk groups. The check-ups frequency is prescribed for each risk group.

2008		 Infrastructural issues considered by the Ministry of Transport and Communication

The Working Group on Infrastructure under the CMU Investors Council met on 12 June 2008 in the premises of the Ministry of Transport and Communication. Chairman of the Working Group on Infrastructure under the CMU Investors Council (hereinafter – Working Group) Deputy Minister of Transport and Communication Mr Igor Urbanskyi stressed the investment projects to be implemented in the framework of the Working Group’s activity. Those were the projects related to Ukrzaliznytsia (arrangement of high-speed traffic of passenger trains) and Ukravtodor (building of ring-road around Kyiv and highway Odesa - Reni).

2008		 Approved: Procedure of auctions on sale of permits for subsoil use

On 4 June 2008 the CMU issued the Resolution approving the Order on Holding Auctions in 2008 on Sale of Special Pemits for Subsoil Use No. 525. The Order defines the procedure of sale of the above permits for subsoile use within the territory of Ukraine, its continental shelf and exclusive (sea) economic zone with the help of auctions. The auction is determined as the way of selling the permits for subsoil use by means of holding the bidding.

2008		 EBA Analytical Review proposals reflected in the Draft Law

MP Tkach submitted to the Parliament the Draft Law on Amendments to Article No. 82 of Land Code, as he had pledged to the EBA members at the EuroDebates on "Free Land Turnover: Pro & Contra" on 27 May 2008. The Draft Law on Amendments and Additions to Ukraine’s Land Code (on foreign legal entities) No. 2600 as of 4 June 2008 states in clear terms and entitles foreign investors to acquire the rights to own non-agricultural land. The Draft Law was elaborated jointly with the EBA Real Estate Committee members within a series of meetings based on the EBA Analytical Review “IN CLOSE UP: Land property rights” proposals.

2008		 Railway tickets sale: meeting with Ukrzaliznytsia representatives

On 9 June 2008 the EBA representatives attended the WG under the Ukrainian State Railway Transport Administration (Ukrzaliznytsia) discussing implementation of the EBA Investment Paper proposals regarding railway tickets. The meeting was headed by Mr Korniyenko, Deputy General Director of Ukrzaliznytsia. There were also representatives of the Head Passenger Department, Head Department on Development and Technical Support at the meeting. On 10 June 2008 the EBA participated in the 5th Session of the Ukrainian Knowledge Economy Dialogue  focusing on the Role of Metrology, Standards, Testing and Quality (MSTQ) in Innovation and Technology Adoption. 2008		 Permits for Re-export of Goods

Since 29 July 2008 the Draft Law on Amendments to Certain Legislative Acts of Ukraine regarding Re-export of Goods is available for public discussion from the official side of the Ministry of Economy of Ukraine. The Draft prescribes amendments to the Customs Code of Ukraine providing for the definition of re-export as the customs regime according to which the goods originating from other countries are exported from the customs territory of Ukraine not later than the term stated by the law beginning from the moment of entry.

On 23.05.08 the EBA representatives had a chance to attend the International Seminar “Modernization of Labour Law in Ukraine in the context of globalization”. This Seminar was organised by the International Labour Organisation (ILO), French Embassy in Ukraine and the Friedrich Ebert Foundation. The participants of the meeting represented the Ukrainian target authorities (Ms Denisova, the Minister of Labour and Social Policy, Mr Khara, the Head of Parliamentary Committee on Social Policy and Labour), NGOs, ILO (Mr Cieniuch, Chief Technical Adviser of the ILO Project) and other international institutions.

On 10.04.08 the Verkhovna Rada of Ukraine ratified the Protocol on Ukraine’s Membership in the World Trade Organization. This was a precondition to formally complete the process of Ukraine’s WTO accession. The WTO will legitimate Ukraine’s membership in 30 days upon the ratification and on condition of the membership and one-time WTO fund fee settlement.

The Draft prescribes amendments to the Civil and Commercial Codes reflecting the EBA Investment Paper proposal to authorize a single body, in particular the State Department of Intellectual Property, to be in charge of registering the commercial concession agreements.

2007		 European Parliament approved the EU-Ukraine Agreements on Visa Facilitation and Readmission
On 13.11.07 Members of the European Parliament voted for ratification of Readmission and Visa Facilitation Agreements with Ukraine. The next and final step from the European side should be ratification of documents by the EU Council of Ministers. Therefore the agreements could be implemented by the end of 2007. The Ukrainian official side emphasized this event to be an evidence of step-by-step execution of internal procedures on the way to enforcement of the above documents by the EU.

2007		 Fourth Stage of the EU-Ukraine IP Dialogue
On 26.10.07 the fourth meeting of the EU-Ukraine IP Dialogue took place in the premises of the European Commission Delegation gathering EC officials, business representatives mostly from the EBA from one side and Ukrainian governmental authorities from the other side for fruitful and efficient discussion. Some of the EBA member companies had taken part in the preparatory meeting held prior to the IP Dialogue to discuss their issues of concern, which then were put forward to the government within relevant agenda points.

2007		 Government Pays Attention to Labour Market Demand in Skilled Workers  
The EBA has numerously raised the issue of the lack of qualified specialists, especially in the technical sphere. In particular, the EBA HR Committee members stressed the need to change the governmental policy in this respect to attract companies interested in employment of qualified human resources to work on enhancement of the educational process. On 11.10.07-12.10.07 the European Crop Protection Association (ECPA) Workshop for Country Drivers from Central and Eastern Europe (CEE) was held in Riga (Latvia). The Workshop gathered the representatives of the Crop Protection Associations and companies from Bulgaria, Czech Republic, Hungary, Latvia, Lithuania, Romania, Russia, Serbia, Slovakia, Slovenia, Turkey and Ukraine. On 09.10.07 the EBA representatives had a chance to meet with officials of  the German Embassy. The meeting was organised with kind assistance of Mrs  Cristiane  Hullmann, Head  of Consular and Legal Department. Being a member of the Public Council under the State Agency on Land Resources of Ukraine, on 13.09.07 the EBA attended its meeting. Although the central body of executive power on land resources issues was reorganized, its functions remained the same. Participants elected the new Head of the Public Council – Mr Prysyazhnyuk, M.P., who stressed an urgent necessity of improving land legislation and promised to be the voice of public body in the Parliament.

2007		 The Draft Housing Code of Ukraine
The Draft was registered in Verkhovna Rada with No 4028 on 30.07.07 being worked out on the instructions of the Cabinet of Ministers of Ukraine as of 04.09.06. The necessity of adopting the Housing Code is said to be stipulated, first of all, by the change of social and economic organization of the state, transfer of Ukraine to the market economy and modern world standards, in particular within housing sector. The Code is believed to become the major legal act in the housing sphere that would define the strategy of providing citizens of Ukraine with the house, reserving and keeping housing resources, booking housing premises and preserving them for temporary absent citizens.

2007		 The Minister of Foreign Affairs of Ukraine signed the EU-Ukraine Agreement on Visa Facilitation and Readmission (updated on 19.06.07)    

On 18.06.07 at the 11th meeting of the Council on the Issues of Cooperation between Ukraine and the European Union there was signed the EU-Ukraine Agreement on Facilitation of Visa Regime and Readmission. As it was agreed earlier it prescribes significant preferences for Ukrainian citizens, in particular it defines the categories of Ukrainians who have the right for five-year visas (journalists, businessmen etc).

On 13.06.07 the President signed the Law of Ukraine on Fundamentals of State Control in the Sphere of Economic Activity. The Law was considered and passed by the Parliament of Ukraine on 05.04.07. The Law is now assigned with No 877–V. The document defines legal and organisational basis to execute state control in the sphere of economic activity as well as names basic principles and procedures for it.

The Bill On Amendments to the Act of Ukraine On Business Entities has passed the first reading in the Parliament on 05.10.06. The Bill has been approved by 236 Parliamentary members. The amendments proposed by the Bill stipulate decrease of quorum for shareholders' meeting from 60% down to 50% of statutory fund.

2006		 State authorities involve EBA expertise in discussing issues of primary concern
Last week there were several focus events initiated by the state authorities and the EBA was invited to participate in. In particular, on 30.10.06 the EBA took part in the meeting of the Working Group on elaboration of the Bill On State Private Partnership, on 31.11.06 the EBA took part in the All-Ukrainian Session on implementation of quality management system in the governmental authorities and on 1.11.06 - in the Seminar: Reform of Standardisation System. On 13.10.06 the Bill on Amendments to the Act of Ukraine on VAT (regarding VAT payment by purchasing automobiles) was registered in the Parliament with No.2011. The Parliamentary Committee on Finance and Banking has recommended to the Parliament to take this Bill as a basis.

2006		 Public Collegium under the Antimonopoly Committee of Ukraine

On 13.10.2006 the EBA took part in a regular meeting of the Public Collegium under the Antimonopoly Committee of Ukraine (AMCU). Representatives of the AMCU presented the Survey on the AMCU activity during three quarters (January - September 2006) in the sphere of economic competition as well as shared information on the AMCU activity in the sphere of public procurement during the first semester of 2006.

On 13.10.06 the EBA took par in the round table: Challenges of single social tax implementation in Ukraine. The event was organised by the Entrepreneurs Council under the Cabinet of Ministers of Ukraine together with the Ministry of Labor and Social Policy of Ukraine in order to discuss the Bill On Single System of Collection and Calculation of  Dues for Obligatory State Insurance.

2006		 EU Intellectual Property Rights Enforcement Survey

The European Commission made a great step forward in sphere of protecting the Intellectual Property Rights (IPR) and fighting with the counterfeiters and piracy in the third countries by releasing the Survey of EU businesses on their experience with IPR enforcement outside the EU in 2005 in its Communication "Global Europe: Competing in the World" on 06.10.06.

2006		 Ukraine acceded to the Kyoto Convention

On 05.10.06 the Parliament of Ukraine adopted the Act of Ukraine On Ukraine's Accession  to the Protocol On Amendments to the International Convention on Simplification and Harmonization  of Customs Procedures. This Act stipulates Ukraine's accession to the Kyoto Convention as amended in 1999.

2006		 EBA assists in facilitating bottlenecks caused by enactment of the Act of Ukraine On Chemical Power Sources (updated on 05.10.06).

The Act of Ukraine On Chemical Power Sources No. 3503-IV adopted on 23.02.2006 was put in force of 01.07.06. According to this Act production, import, storage and utilization of worked out chemical power sources subject to licensing provided according to legislation. Unfortunately no authority was authorized to provide this licensing until 04.10.06, thus customs clearance of all chemical power sources, namely batteries or accumulators, was suspended.

2006		 Progress in the EC-Ukraine negotiations on visa facilitation and readmission agreements

On 10.10.06 the next round of EU-Ukraine negotiations devoted to draft agreements on visa facilitation and readmission took place in Brussels, Belgium. The Ukrainian Delegation was chaired by the Deputy Minister of Foreign Affairs Mr. M. Maimeskul and the EC Delegation was chaired by the Deputy Director-General of DG External Relations Mr. K. Kovanda in Brussels, Belgium.

2006		 Cameral audit procedure conducted by customs officials

The State Customs Service of Ukraine has elaborated and published the Draft Order On Approving the Procedure for Cameral Tax and Duties Audits During Movement of Goods through the Customs Border of Ukraine and Registration of Their Results. The purpose of the Draft Order is to establish unified methodical backgrounds for conducting control measures and registering their results by customs officials.

2006		 Draft amendments to legislation concerning non-agricultural land

The Bill On Amendments to Certain Legislative Acts of Ukraine (concerning non-agricultural  land) has been recently registered in the Parliament with No. 2129 on 25.09.06. This Bill has been submitted to the Parliament by the Parliamentary member, Mrs. Yulia Timoshenko. The main purpose of the Bill  is improvement of land relations regulation through amending the Land Code of Ukraine and other legislative acts of Ukraine.

2006		 Amendments to customs regulation

The State Customs Service of Ukraine (SCSU) has elaborated the draft Resolution of the Cabinet of Ministers of Ukraine (CMU) On Amendments to the CMU Resolution On Preliminary Documentary Control of Goods at the Point of Entry Across the Ukrainian Border No. 269 as of 13.04.05. The draft is aimed to improve the control procedure for goods during their movement through the customs border of Ukraine.

2006		 Structure of the Governmental Committees has been modified

The Cabinet of Ministries of Ukraine (CMU) decided to optimize the number and structure of the Governmental Committees. According to the CMU Resolution No. 1202 the number of the Governmental Committees has been decreased from 7 down to 5. Moreover, now each Governmental Committee will be chaired by the Prime Minister or respective Vice Prime-Minister of Ukraine.
