2008		 The Law on Notary was adopted
The Parliament adopted the Law on Notary (hereinafter – the Law). In general, this Law is aimed at  distributing equal authorities between the state and private notaries and enhancing  control over notaries' activity. The Law envisages institutes and entities which perform notarial acts and those controlling the notarial activity in Ukraine. Provisions of the Law stipulate requirements to the notaries, due to which the person who can become a notary should be the citizen of Ukraine, have a higher legal education, have a strong command of state language, have not less than 3 years of work experience in legal sphere, served internship with office of notary public or with private notary and passed qualification exam.

2008		 The Verkhovna Rada adopted Law on Legal Acts
On 1 October 2008 the Verkhovna Rada of Ukraine adopted the Law on Legal Acts (hereinafter – the Law).  The respective Draft Law was registered in the Parliament with No. 1341-1 on 21 January 2008.  The Law provides for regulation of development and state registration of legal acts. Also the Law defines the system, types and ranking of normative legal acts and provides for common requirements to the drafting methodology.

2008		 Ukrainian technical regulations are in focus of the Parliamentary Committee on Industrial and Regulatory Policy and Entrepreneurship
On 1 October 2008 the EBA took part in the meeting of the Parliamentary Committee on Industrial and Regulatory Policy and Entrepreneurship chaired by Natalia Korolevska. There was a significant list of draft laws foreseen by the meeting’s agenda; however the main focus was address to regulatory issues.

2008		 Encouragement of Construction
On 16 September 2008 the Parliament adopted the Law on Amendments to Some Legislative Acts in terms of Encouraging Construction (hereinafter – the Law). The respective Draft Law was registered in the Parliament with No. 0883 as of 23 November 2007.  Adoption of this Law was envisaged by agreements achieved between the EBA and the Ministry of Regional Development and Construction in view of implementation of the EBA Barriers to Investment in Ukraine proposals.

2008		 Control over Construction Objects
On 17 June 2008 the Ministry of Regional Development and Construction of Ukraine published the Draft Resolution on State Architecture and Construction Supervision (Control) over Construction Objects and Building Materials Production by State Architecture and Construction Inspection and its Regional Branches. This Draft is being currently considered by other Ministries to be supplied to the Cabinet of Ministers of Ukraine for final approval.

2008		 New Addition of Customs Code considered in the Parliament
On 25 September 2008 the EBA was present at the meeting of the Parliamentary Committee on Taxation and Customs Policy. Among other Draft Laws talked over by the Committee members, there was the Draft Law on Amendments to the Customs Code (hereinafter – the Draft Customs Code) No. 2778 as of 16 July 2008 brought up for discussion. The Draft Customs Code is invoked to bring into compliance provisions of the Customs Code of Ukraine and the International Convention on Simplification and Harmonization of Customs Procedures (hereinafter – the Kyoto Convention). There is a range of other international conventions to be harmonized with Ukrainian legislation within the scope of amendments proposed by the Draft Customs Code.

2008		 Corporate Governance under the CMU Investors’ Council
On 25 September 2008 the EBA took part in a meeting of the Working Group on Corporate Governance under the CMU Investors’ Council. There were two Draft Laws brought up for the discussion, which are namely: the Draft Law on Amendments to Some Legislative Acts on Prevention of Illegal Mergers and Takeovers No. 3011 as of 24 July 2008 (hereinafter – the Draft Law No. 3011) and the Draft Provision on Manipulation on the Stock Exchange.

2008		 Law on Joint Stock Companies was adopted in the Parliament
Parliament of Ukraine made a significant step towards enhancing corporate governance regulation in Ukraine. After years of intense and time-consuming consideration and tremendous lobbying efforts of the EBA and other institutions, the Law on Joint Stock Companies has finally been endorsed. Even Speaker of the Parliament Arseniy Yatsenyuk despite his disapproval of this Draft voiced at the meeting with the EBA members last week, was among those 358 of Parliamentary members who voted in favour of this Law as a whole.

2008		 Recent legislative news related to real estate 
The Parliament adopted the Law on Amendments to Some Legislative Acts in terms of Encouraging Construction (hereinafter – the Law), the respective Draft Law was registered in the Parliament with No. 0883 as of 23 November 2007.  The Law foresees changes to the Law on Planning of Territories and Building Development and specifies several definitions, such as urban planning documentation, detailed plan of territories, building intention and others.

2008		 Rules of Pesticide Importation Become more Transparent – a Result of EBA’s Work with Government
On September 3, the Cabinet of Ministers adopted amendments to the Resolution No 288 dated March 4, 1996 On Rules of Issuing Permits for Importation of Unregistered Foreign Pesticides and Agrochemicals. These amendments come as a result of the joint efforts of the European Business Association, the Foreign Investors’ Council under the Cabinet of Ministers and the Government.

2008		 Amendments to the currency regulations of the National Bank of Ukraine
On 5 August 2008 the Ministry of Justice registered the Resolution No. 153 of the National Bank of Ukraine providing amendments to its Resolution No. 281 dated 10 August 2005 approving several currency trading rules. With these amendments the National Bank of Ukraine (NBU) changed the title and some provisions related to the interbank currency system of the Rules on Trading Session and Certain Transactions Related to Sale and Purchase of Foreign Currency and Bank Metals.

2008		 Meeting of Public Councils under the State Authorities
On July 31, 2008 the representatives of public councils met together to discuss burning issues of public councils activity within the framework of cooperation with state authorities. The discussion focused on promotion of monitoring system to coordinate interaction of public councils and state authorities. 2008		 EBA/SCSU negotiations: abolishment of a security deposit (guarantee)
On 31 July 2008 the EBA representatives had a meeting with Mr Gasñhitskiy, Head of Unit on IP Protection of Department for Trade Policy Measures, the State Customs Service of Ukraine (hereinafter - SCSU).  The attendees discussed the EBA Investment Paper proposal on control over movement of goods containing IPR object across the customs border of Ukraine. In particular, the EBA IP Committee members proposed to decrease or abolish the sum of money (EUR 5,000) to be submitted to the SCSU as security deposit or equivalent guarantee prescribed by the SCSU Order No. 520.

2008		 Recent tax-related legislative initiatives
Several tax-related Draft Laws were submitted for consideration to Verkhovna Rada. In particular the Draft Law on Amendments to the Law on Taxation System No. 2768 dated 14 July 2008 envisages a more precise definition of some types of taxes and compulsory payments, in particular related to construction. As stated in the explanatory note, the Law on Taxation System requires amending because of the inconsistency of Ukrainian legislation and negative practices affecting the building and constuction sphere.

2008		 Proposal to Combat Medical Products Counterfeit (continuation)
On 1 July 2008 the Draft Law on Amendments to the Criminal Code of Ukraine and some other Ukrainian regulations No. 2274 was re-submitted to the Parliament of Ukraine. The main changes in both previous and current Drafts lie in strengthening a responsibility for operations related to counterfeit medical drugs – production, distribution, retail and etc. The EBA Health Care Committee took part in the working group within the Ministry of Health and made some proposals.

2008		 Ukraine's High-Ranking Officials met the UEFA Delegates
On 3 July 2008 Ukraine gave a cordial welcome to the Delegation of the Union of European Football Associations (hereinafter – UEFA). As the UEFA President Michel Platini underlined, the visit to Ukraine and Poland aimed to find out whether the countries were well-prepared to host the final round of the UEFA  Championship in 2012. The Parliamentary Committee on Taxation and Customs recommends Verkhovna Rada to approve as a basis the Draft Law on Amendments to the Article 5 of the Law on Corporate Profit Tax (hereinafter – the Draft). The Extended session of the Working Group on Taxation and Customs Policy under the CMU Investors Council (Working Group) took place in the office of the Ministry of Finance of Ukraine on 2 July 2008.

2008		 Round Table on How to Reduce Corruption in Real Estate and Land Permitting System

The Round Table on How to Reduce Corruption while Obtaining a Permit for Construction and Conducting Land-related Operations was organised at the National Union of Journalists of Ukraine. The Round Table was initiated by the project Promoting Active Citizen Engagement (ACTION) in Combating Corruption in Ukraine, which has been launched by the United States Agency for International Development (USAID). Representatives of the state authorities, business and non-governmental organisations attended the Round Table to discuss the pressing problem of corruption in the construction and land permitting system.

On 11 June 2008 the Draft Resolution of the Cabinet of Ministers of Ukraine on Criteria of Dividing Enterprises Based on Risk in their Activity in Production of Goods, Delivery of Services or Execution of Work was published on the web-site of the State Committee for Technical Regulations and Consumer Policy. Based on the risk assessment the enterprises are categorised into high-, medium- and low-risk groups. The check-ups frequency is prescribed for each risk group.

2008		 Infrastructural issues considered by the Ministry of Transport and Communication

The Working Group on Infrastructure under the CMU Investors Council met on 12 June 2008 in the premises of the Ministry of Transport and Communication. Chairman of the Working Group on Infrastructure under the CMU Investors Council (hereinafter – Working Group) Deputy Minister of Transport and Communication Mr Igor Urbanskyi stressed the investment projects to be implemented in the framework of the Working Group’s activity. Those were the projects related to Ukrzaliznytsia (arrangement of high-speed traffic of passenger trains) and Ukravtodor (building of ring-road around Kyiv and highway Odesa - Reni).

2008		 Approved: Procedure of auctions on sale of permits for subsoil use

On 4 June 2008 the CMU issued the Resolution approving the Order on Holding Auctions in 2008 on Sale of Special Pemits for Subsoil Use No. 525. The Order defines the procedure of sale of the above permits for subsoile use within the territory of Ukraine, its continental shelf and exclusive (sea) economic zone with the help of auctions. The auction is determined as the way of selling the permits for subsoil use by means of holding the bidding.

2008		 Ministry of Transport and Communication develops State Programme on Railway Transport  Reform

On 10 June 2008 the Minister of Transport and Communication Mr Vinsky announced that the Ministry was working on the radical reform of railway transport in Ukraine. 2008		 EBA Analytical Review proposals reflected in the Draft Law

MP Tkach submitted to the Parliament the Draft Law on Amendments to Article No. 82 of Land Code, as he had pledged to the EBA members at the EuroDebates on "Free Land Turnover: Pro & Contra" on 27 May 2008. The Draft Law on Amendments and Additions to Ukraine’s Land Code (on foreign legal entities) No. 2600 as of 4 June 2008 states in clear terms and entitles foreign investors to acquire the rights to own non-agricultural land. The Draft Law was elaborated jointly with the EBA Real Estate Committee members within a series of meetings based on the EBA Analytical Review “IN CLOSE UP: Land property rights” proposals.

2008		 Railway tickets sale: meeting with Ukrzaliznytsia representatives

On 9 June 2008 the EBA representatives attended the WG under the Ukrainian State Railway Transport Administration (Ukrzaliznytsia) discussing implementation of the EBA Investment Paper proposals regarding railway tickets. The meeting was headed by Mr Korniyenko, Deputy General Director of Ukrzaliznytsia. There were also representatives of the Head Passenger Department, Head Department on Development and Technical Support at the meeting. 2008		 Role of Metrology, Standards, Testing and Quality in Innovation and Technology Adoption

On 10 June 2008 the EBA participated in the 5th Session of the Ukrainian Knowledge Economy Dialogue  focusing on the Role of Metrology, Standards, Testing and Quality (MSTQ) in Innovation and Technology Adoption. This event was organised by the World Bank Office in Ukraine. Among the main panelists there was Mauricio Frota, the Chairman of Post–Graduation Metrology for Quality and Innovation.

Recently the EBA participated in the meeting of Working Groups of the Expert Council under the Parliamentary Committee on Regulatory Policy and Entrepreneurship. 2008		 Permits for Re-export of Goods

Since 29 July 2008 the Draft Law on Amendments to Certain Legislative Acts of Ukraine regarding Re-export of Goods is available for public discussion from the official side of the Ministry of Economy of Ukraine. The Draft prescribes amendments to the Customs Code of Ukraine providing for the definition of re-export as the customs regime according to which the goods originating from other countries are exported from the customs territory of Ukraine not later than the term stated by the law beginning from the moment of entry.

2008		 The meeting of Concessions Working Group was held yesterday on the premises of Ministry of Transport and Communication of Ukraine.
On 02.06.08 the EBA took part in the initial meeting of the Concession Working Group of the Investors Council under the Cabinet of Ministers of Ukraine. This Working Group was established under the Ministry of Transport and Communication of Ukraine. The core topic of the meeting was discussion of amendments to the Law On Concessions of building and operation of automobile roads.

On 28.05.08 the Intergovernmental Commission on Standard, Registration and Quality Control of Medical Drugs and Medical Devices for CIS-states had another meeting in Issyk Kul (Kyrgyzstan). Industrial Associations covering the EBA Health Care Committee, Byelorussia Association of International Pharmaceutical Manufactures and Representatives of Kazahstan International Manufacturers presented the Rules enabling pharmaceutical companies to promote medical drugs to Health Care professionals.

2008		 Follow-up: International Seminar on Modernization of Labour Law in Ukraine
On 23.05.08 the EBA representatives had a chance to attend the International Seminar “Modernization of Labour Law in Ukraine in the context of globalization”. This Seminar was organised by the International Labour Organisation (ILO), French Embassy in Ukraine and the Friedrich Ebert Foundation. The participants of the meeting represented the Ukrainian target authorities (Ms Denisova, the Minister of Labour and Social Policy, Mr Khara, the Head of Parliamentary Committee on Social Policy and Labour), NGOs, ILO (Mr Cieniuch, Chief Technical Adviser of the ILO Project) and other international institutions.

2008		 Ukraine ratifies the WTO accession Protocol
On 10.04.08 the Verkhovna Rada of Ukraine ratified the Protocol on Ukraine’s Membership in the World Trade Organization. This was a precondition to formally complete the process of Ukraine’s WTO accession. The WTO will legitimate Ukraine’s membership in 30 days upon the ratification and on condition of the membership and one-time WTO fund fee settlement.

The Draft Law on Amendments to Articles 116, 124 of the Land Code of Ukraine (regarding obtainment of leasehold right to land plots according to results of auction) No 1368 and the Draft Law on Amendments to Land Code of Ukraine regarding Supplementation of Definition "Categories of Lands according to their Target Designation" No 2091 were registered in Verkhovna Rada on 20.02.08 and 19.02.08 respectively.

2008		 President suggest restoring penalties for untimely VAT refund
On 25.02.08 the President signed the Decree No 155/2008.  With  this  Decree  the  President  putted  into ffect the Decision  of  the National Security & Defense Council (NSDC) on Status of  Implementation  of  NSDC's Decision as of 15.12.06 on Measures for Preventing  and Neutralization of the National Security Hazards Caused by Unstable Legislative Regulation of VAT Administration.

2008		 Ukrainian agricultural sector in the WTO conditions
On 20.02.08 the EBA took part in a briefing with Head of the Parliamentary Committee on Agrarian Policy Mr Mykola Prysiazhnyuk and Land Relations for discussing the outcomes of the extended meeting of the Parliamentary Committee with the Government representatives devoted to considering possible ways of the Ukrainian agricultural sector’s adjustment to the WTO conditions.

2008		 Main trends of monetary policy and anti-inflationary measures of the Government
On 07.02.08 the EBA took part in the Round Table arranged by the Parliamentary Committee on Finance and Banking to discuss main trends in monetary policy of Ukraine. The list of keynote speakers included Mykola Azarov, Head of the Parliamentary Committee, Ihor Shulmilo, Executive Direction on Economic Policy of the National Bank of Ukraine, Anatoliy Maksyuta, First Deputy Minister of Economy, other Government representatives and financial experts.

2008		 Revision of  the Law on State Land Cadastre (updated 08.02.08)
The Parliamentary Committee on the Issues of Agrarian Policy and Land Relations is considering the draft of the Resolution on Follow-up Revision of Law of Ukraine on State Land Cadastre that was submitted to Verkhovna Rada on 23.11.07 with No 0855-Ï by MP Tkachenko. The draft prescribes for envisaging in the above Law not only issues dealing with agricultural but other land types, as well as requires its soonest adoption.

The Parliamentary Committee on the Issues of Economic Policy prepares for consideration the Draft Law on State Registration of Ownership Rights to Immovable Property and Encumbrances to them registered with No 1328 on 12.01.08. On 31.01.08 the State Service of Medical Drugs and Medical Devices of Ukraine initiated the Press-conference Presentation of Rules for Promoting of Medical Drugs by Pharmaceutical Companies to Health Care Professionals. On 23.01.08 the Draft Law on Packaging and Packaging Waste was registered in the Parliament with No 1415. The Draft Law was initiated by several Members of the Parliament including Mrs Ksenia Lyapina who was actively involved together with the EBA and UkrPEK in promoting reforms in waste management system in Ukraine.

On 17.01.08 the Parliament of Ukraine registered the Draft Law on Amendments to Certain Laws of Ukraine (concerning standardization and obligatory certification) No 1363 initiated by the President of Ukraine. The Draft Law stipulates abolishment of mandatory standards application and obligatory certification of certain goods and services.
